**1. WARRANTY COVERAGE & DURATION**

TXA warrants that its products, including but not limited to engine bearings, pistons, cylinder liners, piston rings, and associated components, shall be free from defects in material and workmanship when used in normal service and operating conditions. This warranty extends for a period of **twelve (12) consecutive months from the date of original installation**, or **eighteen (18) consecutive months from the date of shipment by TXA**, whichever occurs first.

To maintain warranty validity, the product must be installed by qualified personnel in accordance with TXA's published technical specifications and installation guidelines. The warranty coverage is expressly limited to the replacement or repair of the defective product itself, as further described herein.

**2. WARRANTY CLAIM PROCEDURE**

All warranty claims must be initiated by the original purchaser or an authorized TXA distributor. To initiate a claim, the claimant must submit a complete warranty claim package to TXA's designated warranty department within **thirty (30) calendar days** of discovering the alleged defect. The claim package must include, at minimum:

- A fully completed TXA Warranty Claim Form (current version)

- Legible copy of the original sales invoice or packing slip

- Digital photographs clearly showing:

  - The defective product's TXA part number and batch code

  - The defect in relation to the installed assembly

  - The mating or adjacent components

- A detailed written statement describing:

  - The operating conditions at time of failure

  - The symptoms leading to the failure

  - Total equipment runtime (hours/miles) since installation

- Documentation of proper installation (e.g., torque values, clearance measurements)

Incomplete submissions will not be processed and will be returned to the claimant.

**3. INVESTIGATION & REMEDY**

Upon receipt of a complete claim package, TXA will conduct a technical evaluation. TXA reserves the right to inspect the defective product and equipment at its discretion, either on-site or by requiring return of the product to a TXA-designated facility. All return shipments require a **Return Material Authorization (RMA) number** issued by TXA; unauthorized returns will be refused.

If TXA determines, in its sole judgment, that the product failure is due to a defect in materials or workmanship covered under this warranty, TXA will, at its option:

- Provide a replacement product of the same or most comparable type

- Issue a credit memo for the purchase price of the defective product

This remedy constitutes the exclusive and sole liability of TXA and the purchaser's exclusive remedy.

**4. WARRANTY EXCLUSIONS**

This warranty shall not apply to any product that has been:

- Subjected to misuse, neglect, accident, improper installation, or improper storage

- Used in applications beyond its published specifications or intended purpose

- Installed without following TXA's explicit installation instructions

- Modified, repaired, or altered without TXA's prior written authorization

- Damaged due to contaminated fuel, lubricants, or cooling systems

- Affected by improper maintenance practices or inadequate lubrication

- Purchased through unauthorized sales channels

- Subject to normal wear and tear, corrosion, or cosmetic imperfections

**5. DISCLAIMER OF CONSEQUENTIAL & INCIDENTAL DAMAGES**

IN NO EVENT SHALL TXA BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR INABILITY TO USE ITS PRODUCTS, INCLUDING BUT NOT LIMITED TO:

- Loss of profits, revenue, or business opportunities

- Equipment downtime or loss of use

- Cost of substitute equipment or services

- Labor charges for removal, installation, or diagnostics

- Damage to other components, machinery, or property

- Transportation, travel, or lodging expenses

TXA'S TOTAL AGGREGATE LIABILITY SHALL IN NO CASE EXCEED THE ORIGINAL PURCHASE PRICE OF THE SPECIFIC PRODUCT FOUND TO BE DEFECTIVE.

**6. DISCLAIMER OF IMPLIED WARRANTIES**

ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED. THIS LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY TXA AND SUPERSEDES ALL PRIOR AGREEMENTS, COMMUNICATIONS, AND REPRESENTATIONS, WHETHER ORAL OR WRITTEN.

**7. GENERAL PROVISIONS**

- This warranty is non-transferable and applies only to the original end-user purchaser.

- Any legal action related to this warranty must be commenced within one (1) year after the cause of action accrues.

- This warranty shall be governed by and construed in accordance with the laws of the State of Texas, United States.

- TXA reserves the right to modify or improve its products without obligation to modify previously manufactured products.
